Validity Screening Solutions is committed to transparency. An important part of your background screening program involves compliance with various legal principles. Organizations that create, maintain, use, and/or disseminate personal information must take reasonable precautions to protect it from loss, misuse, unauthorized access, and disclosure.
In order to protect consumers’ personally identifiable information and minimize exposure and liability, beginning March 15, 2020, Validity Screening Solutions will perform a daily purge of its data, only keeping consumer profiles and related consumer reports for a period of 5 years. This length of time takes into consideration the statute of limitation under Section 618 of the FCRA:
§ 618. Jurisdiction of courts; limitation of actions [15 U.S.C. § 1681p]. An action to enforce any liability created under this title may be brought in any appropriate United States district court, without regard to the amount in controversy, or in any other court of competent jurisdiction, not later than the earlier of (1) 2 years after the date of discovery by the plaintiff of the violation that is the basis for such liability; or (2) 5 years after the date on which the violation that is the basis for such liability occurs.
Profiles entered prior to March 15, 2015 will be purged on March 15, 2020. Data purges will continue daily. Once the profiles have been purged, they will no longer be available on the Validity Screening Solutions platform and they will not appear on any iDsource reports.
