Legislative Update: EU-U.S. Privacy Shield Framework

The European Union recently adopted the new EU-U.S. Privacy Shield Framework on July 12, 2016, to govern data privacy and transfers originating in the EU and arriving in the U.S. This new framework replaces the previous Safe Harbor data privacy and transfer regulation that was sited by the EU and U.S. Department of Commerce as being outdated for today’s consumer privacy needs. Self certification under this new framework shall begin on August 1, 2016 by companies participating in data transfers from the EU to the U.S. Companies who are requesting consumer data (reports) from the EU should be advised to begin discussions with their legal counsel on how best to alter their policies and procedures to best accommodate the new regulations. In the coming year, the European Commission will be configuring how the new Privacy Shield will be intertwined within the EU-wide General Data Protection Regulation which takes effect in 2018.
